Indian River County filed another lawsuit on January 16 in an attempt to shut down Virgin Trains’ plans for a higher-speed passenger train rail through the Treasure Coast. This lawsuit involves 21 crossings along the Florida East Coast Railway corridor within Indian River County.
Virgin Trains might sound like an unfamiliar name, but it was formerly Brightline. Virgin Trains needs crossing improvements in order to run 32 higher-speed passenger trains each day. Indiana River County’s lawsuit argues that the county should not be required to pay for those crossing improvements. The county has always maintained the crossing due to an agreement with FEC, which is the freight railroad. Indian River County argues that the agreement it has is with FEC railway, not Virgin Trains.
The county claims in the lawsuit that Virgin Trains can’t be considered a third-party beneficiary of the agreements between FEC Railway and Indian River County.
